Terms of Service
These Terms of Service ("Terms") govern your use of the Club Games mobile application, website, and related services (collectively, the "Service") operated by Forte Apps LLC ("we", "us", or "our"). By accessing or using the Service, you agree to these Terms.
1. The Service
Club Games is a social gaming platform where you can join a public room or private clubs and play multiplayer table games with virtual club chips. The Service is for entertainment. Virtual chips have no cash value, are not redeemable for money through the app, and do not constitute real-money gambling.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for ensuring your use of the Service complies with applicable laws.
3. Your account
You are responsible for safeguarding your sign-in credentials and for activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
4. Clubs, chips, and gameplay
Club memberships, roles, bankrolls, and game outcomes are managed by the Service and club administrators according to the features we provide. You grant us a limited license to host, process, and display information you submit solely to operate the Service. You represent that you have the right to share any information you enter.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harassing purposes
- Attempt to access another user's account or data without authorization
- Cheat, exploit bugs, or interfere with fair gameplay
- Interfere with or disrupt the Service or its security
- Reverse engineer or scrape the Service except as permitted by law
6. No professional advice
Club Games does not provide legal, financial, or gambling advice. Virtual chips are entertainment only.
7. Third-party services
Hosting, app distribution, email, and notifications rely on third parties, including Railway (hosting and database), Expo (mobile builds, over-the-air updates, and push delivery), Resend (transactional email), and Apple (push notifications and the App Store). Your use of those features may also be subject to their terms and policies.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GAME OR BANKROLL RECORDS WILL BE ACCURATE OR COMPLETE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, VIRTUAL CHIPS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive termination will survive.
11. Changes
We may modify these Terms or the Service. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction.
